Kodak Black to appeal 46-month prison sentence

Kodak Black’s lawyer Bradford Cohen is reportedly attempting to reduce the rapper’s sentence due to a technicality. According to a report by TMZ, Kodak and his attorney are planning to appeal his 46-month prison sentence.

Cohen claims that Kodak was incorrectly labeled as a prior convicted felon, a technicality that could have affected his sentence. While Kodak has previously entered guilty pleas, the plea deals would have kept convictions off his record. Since he is not a prior convicted felon, Cohen believes the mislabeling caused him to have a harsher sentence.

Kodak was sentenced on federal weapons charges back in November and is currently slated to be released in August of 2022. By appealing his sentence, Cohen aims to bring his release date to late 2021, instead.

“Yes the appellate brief should be filed this week,” Cohen wrote on Instagram on Tuesday (Feb. 4). “It’s not a question of ‘I got screwed.’ Its a question of law. Kodak was never a convicted felon previous to this charge. This charge in federal court was a false reporting charge for failing to disclose that he had a pending charge while applying for a firearm. If the appeal is successful, it would shave about 10 more months off the 2022 release date.”

Last month, the rapper was transferred out of his Miami prison, following his allegations of abuse. Kodak said prison guards were “strategically” conspiring to kill him and claimed he had been denied visitation by his mother and girlfriend, suffered mail tampering and received an empty tray for New Year’s breakfast.

After meeting with Kodak at the Oklahoma Federal Transition Center a week later, Cohen said the rapper was “in good spirits.”

“We will address the issues in FDC Miami in good time,” he had written on Instagram. “It was good to see [Kodak] and he was in good spirits. He is working on new projects and reading. He wants to thank all of you for the support.”
